Warranty

Congratulations on the purchase of your new Metta Bed® mattress (the "Mattress"). Your Mattress is covered by a 20-year, limited warranty (the "Warranty"). Please read this Warranty carefully. This Warranty gives you specific legal rights. You may also have other rights, which vary from state to state.

Covered Product

This Warranty extends to the Mattress when purchased directly from Mountain West Sleep Products, LLC ("Sleep West") at www.mettabed.com or at authorized retail locations operated by Mountain West Sleep Products or its partners, for exclusive use within the Continental United States. Some portions of this Warranty also extend to the mattress cover (the "Cover") when sold with the Metta Bed mattress.

You must use your Mattress as directed and as intended for it to be covered by this Warranty. This Warranty is void if you use the Mattress in a manner other than its intended use (including by configuring your Metta Bed mattress to use a base layer that is not at least medium firmness), or if your Mattress is not properly supported by a structurally sound, firm, flat and well-ventilated foundation or bed base.

To be considered structurally sound, for the purpose of this Warranty, foundations and bed bases (including box springs or power bases) must be rated to support the collective weight of the Mattress and up to two (2) sleepers. Slatted foundations including platform beds must feature slats that are spaced not greater than 3" apart.

Who This Warranty Extends To

This Warranty extends to the original consumer purchaser (the "Purchaser") of the Mattress, who must be 18 years of age or older, and is not transferrable. For the purpose of this Warranty, the Purchaser is the adult person whose name appears as the sold-to party on the original order receipt, as issued by Sleep West, from the www.mettabed.com website. The Purchaser must retain a copy of the original order receipt as proof of purchase.

What This Warranty Covers

Your Mattress is warrantied against significant manufacturing defects ("Defects") in workmanship and material that occur within the course of normal, residential, in-home use and proper handling. This includes (1) depressions within latex foam products greater than 1.5" caused by deterioration (and not associated with or caused by improper support of the Mattress or caused by the repetitive motion of an adjustable base) and (2) any physical flaw in the foam material that causes it to split or crack. This Warranty does not cover changes to the Mattress including comfort and feel that occur over time, as a result of normal use.

The Cover zipper assembly is covered by this Warranty. The exclusive remedy for warrantable-defect claims related to the Cover will be a one-time replacement or repair.

Stains, tears, soiling, burns, shrinking or other dimensional changes, loose threads, creases, mold, mildew and dampness, aroma, individual comfort preference, allergies, sensitives and discoloration are not covered by this Warranty.

Your Mattress is made by hand. All stated dimensions are approximate and all finishes are subject to minor variation. Slight dimensional and visual variations, including minor cosmetic flaws are not covered by this Warranty.

Sleep West's Responsibilities

Sleep West warrants the Mattress to the original Purchaser against Defects, as set forth above, for a period of 20 years from the date of purchase, subject to the terms of this Warranty.

Your Responsibilities

To receive benefits under this Warranty, during the term of this Warranty, you (the original Purchaser) must complete a warranty review request form and be provided with an RMA# (your original proof of purchase is required). Once you have received an RMA#, you must return the Mattress to Sleep West within 15 calendar days (specific return instructions are provided when your RMA# is issued). Shipping costs for Mattress or Cover returns are paid by Sleep West. Products received without an RMA# will be refused or returned.

As applicable, and at Sleep West's sole discretion, your Mattress or Cover will be repaired or replaced, then made ready for return shipment to you. You are responsible for return-freight charges associated with repaired or replaced product.

Sleep West reserves the right to request additional information to assist with the determination of your warranty claim. This includes but is not limited to photographs and further information that was not collected by the warranty request form. Sleep West reserves the right to refuse warranty claims that it believes to be fraudulent, otherwise misrepresented or when a warrantable defect is not present or cannot be verified.

If identical materials are not available at the time of service, Sleep West reserves the right to substitute materials, which may be visibly different from the original materials, but will be of equal or higher quality.

If your Mattress is repaired or replaced, this Warranty will not be renewed or extended. 

Proration of Warranty

All necessary replacements or repairs that are determined by Sleep West to be caused by manufacturing defects will be non-prorated for ten (10) years from the date of purchase. After ten years, repairs or replacement will be prorated based on a 20/2 percentage basis such that during the 11th year, you will receive a repair or replacement credit equal to 20% of the original price. The credit will decrease by 2% each year for the following nine years.

No Medical or Health Claims

Sleep West makes no health claims regarding its products and does not warrant that the Mattress, Cover or any other product is suitable for any person’s medical condition.

Disclaimer, Limitation on Liability

Any and all implied warranties shall not exceed in duration the term of this Warranty. This Warranty begins on the day you purchase your Mattress. 

TO THE EXTENT PERMISSIBLE BY APPLICABLE LAW, THE MATTRESS AND COVER ARE PROVIDED “AS IS” AND THIS WARRANTY AND ANY IMPLIED WARRANTIES ARE YOUR EXCLUSIVE WARRANTIES AND REPLACE ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE AND JURISDICTION TO JURISDICTION.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND EXCEPT AS SET FORTH IN THIS WARRANTY, IN NO EVENT WILL SLEEP WEST, ITS SUPPLIERS OR AFFILIATES BE LIABLE FOR PROCUREMENT OF SUBSTITUTE PRODUCTS OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF OR RELATED TO THE MATTRESS OR COVER OR THEIR USE BY YOU OR ANY THIRD PARTY, WHETHER UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), INDEMNITY, PRODUCT LIABILITY OR OTHERWISE. THIS LIMITATION WILL APPLY EVEN IF SLEEP WEST HAS BEEN ADVISED OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. SLEEP WEST’S TOTAL LIABILITY WILL NOT EXCEED THE PURCHASE PRICE PAID FOR THE MATTRESS GIVING RISE TO SUCH LIABILITY.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

Arbitration

Any controversy or claim arising out of or relating to this Warranty will be settled by binding arbitration in accordance with the rules of the American Arbitration Association.

Arbitration will take place in Cheyenne, WY.

Governing Law

This Warranty and the rights of the parties under this Warranty shall be governed by, interpreted, and enforced in accordance with the laws of the State of Wyoming without regard to conflicts of law. Each party hereto agrees that the exclusive venue for any action or proceeding relating to this Agreement shall be Laramie County, Wyoming.
